NARRATIVE/JUSTIFICATION FOR JUDGMENT OF COMPLIANCE
Southeast Kentucky Community and Technical College (SKCTC) and the Kentucky Community and Technical College System (KCTCS) support and value academic freedom. The policies established by KCTCS and followed by SKCTC provide a protocol that adequately protects faculty, staff and students. These policies ensure freedom of thought and expression, essential to any public Institution of higher learning.
The basis for the KCTCS policy on academic freedom is found in the 1940 Statement of Principles of Academic Freedom as published by the American Association of University Professors [1]. KCTCS defines the scope of academic freedom and the processes by which such freedom is maintained in KCTCS Policy [2]. This policy is published in the SKCTC Faculty Handbook [3] which is distributed both in hard copy and electronic format. While academic tenure is essential for the protection of academic freedom, all faculty members, tenured or non-tenured, have an equal right to academic freedom and bear the same academic responsibilities implicit in that freedom. The employment practices of the College are also formulated in accordance with KCTCS policy [4]. KCTCS also has in place a grievance and complaint policy and procedure for faculty to follow when academic freedom is challenged [5]. Pertinent to the concept of academic freedom is the policy for which faculty may appeal any condition of termination if he/she believes that the termination may result as a violation of academic freedom [6]. Additionally, the Faculty Affairs Committee, a standing committee of the SKCTC Faculty, makes recommendations in matters pertaining to academic freedom. Academic freedom pertaining to students is protected by the KCTCS Student Code of Conduct Section 1.2 [7] and Section 2.4, Student Appeals and Responsibilities [8].
